Hamas has been both a political movement and a belligerent at least since 2007, while the Israelis have been a belligerent since 1967.

If Hamas captures civilians from the other side, the captured persons are civilian detainees, not hostages. Those captured while wearing a uniform or combat fatigues are prisoners of war.
